1. PREAMBLE, ACCEPTANCE, AND LEGAL BINDING EFFECT

1.1 These Terms of Service (the "Terms") constitute a legally binding agreement between Visa Jobs Hub LTD, a company incorporated in England and Wales ("Visa Jobs Hub", "the Company", "we", "us", or "our"), and any individual or legal entity ("User", "you", or "your") that accesses, registers for, subscribes to, or otherwise uses the Company's website, platform, software, tools, databases, content, or related services (collectively, the "Services").

1.2 By accessing or using any part of the Services, whether as a registered user or as a visitor, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety, together with any additional policies referenced herein, including but not limited to the Privacy Policy.

1.3 If you do not agree to these Terms in full, you must immediately discontinue access to and use of the Services and must not create an account, subscribe, or otherwise engage with the platform.

1.4 These Terms apply to all Users, including but not limited to:

  • (a) job seekers;
  • (b) employers;
  • (c) universities and educational institutions;
  • (d) other business or organisational users; and
  • (e) visitors who access the Services without registration.

2. DEFINITIONS, INTERPRETATION, AND CONSTRUCTION

2.1 In these Terms, unless the context otherwise requires:

  • "Account" means a registered user account created to access the Services.
  • "Content" means all information, text, data, job listings, postings, materials, software, code, databases, and documentation made available through the Services.
  • "Employer" means any individual or organisation that posts job opportunities or recruitment-related content on the Services.
  • "Subscription" means a paid, recurring access plan granting enhanced or continued access to the Services.
  • "User Content" means any information, data, documents, CVs, resumes, or materials submitted by Users.

2.2 Headings are for convenience only and shall not affect interpretation.

2.3 Any reference to legislation includes any amendment, re-enactment, or replacement thereof.

3. DESCRIPTION, NATURE, AND LIMITATION OF THE SERVICES

3.1 Visa Jobs Hub provides a technology-based informational platform designed to assist international job seekers in identifying job opportunities that may offer visa sponsorship.

3.2 The Services are limited strictly to the provision of information, data aggregation, and digital tools. The Company does not, under any circumstances:

  • (a) act as an employer, recruiter, agent, intermediary, or representative;
  • (b) participate in or influence hiring decisions;
  • (c) vet, verify, assess, or endorse Employers or job listings;
  • (d) provide immigration, visa, legal, or professional advice;
  • (e) liaise with government or immigration authorities on behalf of Users.

3.3 Employers are solely responsible for the accuracy, legality, completeness, and legitimacy of all job postings and recruitment-related information.

4. ABSENCE OF WARRANTIES, REPRESENTATIONS, AND GUARANTEES

4.1 The Company makes no representations, warranties, or guarantees, whether express, implied, statutory, or otherwise, regarding:

  • (a) the accuracy, completeness, or reliability of job listings;
  • (b) the availability of visa sponsorship for any role;
  • (c) the likelihood of securing interviews, employment, or job offers;
  • (d) the success, approval, or outcome of any visa or immigration application;
  • (e) the conduct, solvency, or legitimacy of Employers.

4.2 Users expressly acknowledge that employment outcomes and immigration decisions depend on numerous factors outside the Company's control, including employer discretion and government authority decisions.

5. ELIGIBILITY, AGE, AND CAPACITY

5.1 The Services are available only to individuals aged 18 years or older.

5.2 By using the Services, you represent and warrant that:

  • (a) you meet the age requirement;
  • (b) you have the legal capacity to enter into binding agreements;
  • (c) you are not prohibited from using the Services under applicable law.

6. ACCOUNT REGISTRATION, SECURITY, AND RESPONSIBILITY

6.1 To access certain features, Users must create an Account and provide accurate, current, and complete information.

6.2 Users are solely responsible for:

  • (a) maintaining the confidentiality of login credentials;
  • (b) all activity conducted through their Account;
  • (c) promptly notifying the Company of unauthorised access or security breaches.

6.3 The Company reserves the right to suspend or terminate Accounts that contain false, misleading, or incomplete information.

7. USER OBLIGATIONS, CONDUCT, AND RESTRICTIONS

7.1 Users agree to use the Services lawfully, ethically, and in good faith.

7.2 Users shall not, whether directly or indirectly:

  • (a) misrepresent qualifications, experience, or immigration status;
  • (b) upload unlawful, misleading, or discriminatory content;
  • (c) harass, abuse, or threaten other Users or Employers;
  • (d) attempt unauthorised access to systems or data;
  • (e) scrape, harvest, reverse-engineer, or exploit the Services;
  • (f) use the Services for unlawful or deceptive purposes.

8. SUBSCRIPTIONS, FEES, AND BILLING TERMS

8.1 Certain features of the Services are available only through paid Subscriptions.

8.2 By subscribing, Users authorise the Company and its payment processor, Stripe, to charge applicable fees on a recurring basis.

8.3 Subscription fees:

  • (a) are charged in advance;
  • (b) are non-refundable except where required by law;
  • (c) remain payable regardless of usage.

8.4 The Company reserves the right to modify pricing, plans, or billing cycles upon reasonable notice.

9. PAYMENTS AND THIRD-PARTY PROCESSORS

9.1 Payments are processed exclusively by third-party payment processors.

9.2 The Company does not store payment card or banking details.

9.3 The Company bears no responsibility for failures or breaches attributable to third-party processors.

10. USER CONTENT, OWNERSHIP, AND LICENSING

10.1 Users retain ownership of User Content they submit.

10.2 By submitting User Content, Users grant the Company a worldwide, non-exclusive, royalty-free, sublicensable licence to use, store, display, transmit, and process such content solely for the purpose of operating and providing the Services.

10.3 Users acknowledge that any User Content voluntarily shared with Employers is shared at the User's own risk.

11. INTELLECTUAL PROPERTY RIGHTS

11.1 All intellectual property rights in the Services, including software, databases, branding, trademarks, and Content, belong to Visa Jobs Hub LTD or its licensors.

11.2 Users are granted a limited, revocable, non-exclusive, non-transferable licence to access the Services for lawful purposes only.

12. SERVICE AVAILABILITY, MODIFICATIONS, AND DISCONTINUATION

12.1 The Services are provided on an "as is" and "as available" basis.

12.2 The Company does not guarantee uninterrupted, error-free, or secure access.

12.3 The Company may modify, suspend, restrict, or discontinue any aspect of the Services at any time without liability.

13. SUSPENSION AND TERMINATION

13.1 The Company may suspend or terminate access immediately where:

  • (a) these Terms are breached;
  • (b) fraudulent or abusive activity is suspected;
  • (c) required by law or regulatory authority.

13.2 Upon termination, all licences granted under these Terms shall immediately cease.

14. DISCLAIMERS

14.1 To the fullest extent permitted by law, all warranties, conditions, and representations are expressly excluded, including implied warranties of merchantability, fitness for purpose, and non-infringement.

15. LIMITATION OF LIABILITY

15.1 To the maximum extent permitted by law, the Company shall not be liable for:

  • (a) loss of income, profits, or opportunities;
  • (b) employment or immigration outcomes;
  • (c) data loss or corruption;
  • (d) indirect, incidental, or consequential damages.

15.2 The Company's total aggregate liability shall not exceed the amount paid by the User in the twelve (12) months preceding the claim.

16. INDEMNIFICATION

16.1 Users agree to indemnify and hold harmless Visa Jobs Hub LTD from any claims, losses, damages, liabilities, or expenses arising from:

  • (a) breach of these Terms;
  • (b) misuse of the Services;
  • (c) violation of applicable laws or third-party rights.

17. FORCE MAJEURE

17.1 The Company shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, government actions, internet failures, or labour disputes.

18. ASSIGNMENT

18.1 The Company may assign its rights and obligations under these Terms without restriction.

18.2 Users may not assign rights without prior written consent.

19. SEVERABILITY

19.1 If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

20. GOVERNING LAW AND JURISDICTION

20.1 These Terms are governed by the laws of England and Wales.

20.2 The courts of England and Wales shall have exclusive jurisdiction.

21. ENTIRE AGREEMENT

21.1 These Terms, together with the Privacy Policy, constitute the entire agreement between the parties.

22. AMENDMENTS

22.1 The Company may amend these Terms at any time. Continued use constitutes acceptance.
